Introduction

Thomassen Energy BV (“Thomassen”) is a part of Hanwha Impact Group companies, an aftersales services provider for multi-OEM platform gas turbine plants and a manufacturer and supplier of goods for aftersales services.

This Privacy Policy applies to Thomassen website and describes our policies and practices regarding collection and use of your personal data and sets forth your privacy rights.

Your privacy and trust are important for us. We acknowledge that information privacy is an on-going responsibility. This Policy from time to time will be updated in order to inform you on adoption of our new personal data practices.

The type of personal information we collect

We currently collect and process the following information, if you directly make it available to us:

  • Personal identifiers, contacts (for example, name, phone number, e-mail address, and other contact details)
  • Place of work, job title
  • Photo and video records
  • Job applicants’ data contained in CV

Moreover, we process certain non-directly identifying information when you visit our website, such as Internet protocol (IP address), general location data (region, where your device is accessing the internet), browser type, operating system and other information about the usage of our web-site.

We do this in order to provide you with better services and design our website to improve your experience and needs, diagnose problems with our server, analyse trends and gather broad demographic information that assists us in identifying visitor’s preferences.

With respect to processing of your personal information, Thomassen disclaims any legal duty to verify the accuracy of any personal information which you provide to us through our website.

How we get the personal data and why we process it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  1. Request for the information or quotations about any of our productsor services
  2. Job application
  3. Use or view our website via your browser’s cookies
  4. Connecting to our social media accounts
  5. Provision of a feedback on any of our message boards or via e-mail
  6. Enrolment in conferences and events organized by Thomassen or Hanwha Impact Group
  7. To prevent and detect fraud

For example, if you fill out an online contact form or otherwise request information about the products or services, Thomassen will use your personal data provided to us and contact you regarding your interest in our products or services. We refer hereto to Article 6.1(b) of the Regulation 2016/679/EU (“GDPR”) to define the legal basis for the processing.

Based on Articles 6.1(a) of the GDPR upon your express consent or based on Article 6.1(f) of the GDPR pursuing the legitimate interest, Thomassen can use and process your personal data for marketing purposes, updates and news on our products and services. We shall not sell or otherwise market your personal data to third parties. However, upon your express consent we can pass your personal data to our affiliated companies and business partners, so that they can contact you directly.

Our parent company is in the United States. Our other affiliated companies are in South Korea, United Arab Emirates and in other countries of the world. We work closely with our affiliates in provision of services and delivery of products to the customers. Therefore, by sending your requests on our products and services you acknowledge that your information may be transferred to third countries. Lawful basis for the processing in this case is defined in Article 6.1(b) of the GDPR - for the performance of a contract and Article 6.1(f) - legitimate interest. Thomassen provides safeguards by entering the EU standard contractual clauses for the transfer of personal data to third countries (where such transfer is appropriate).

If you apply for a job or send an open application letter to us, we shall process your personal data based on our legitimate interest in accordance with Article 6.1(f) of the GDPR.

If you seek clarification on received by you business proposals, job vacancies, etc., about which you have doubt whether they are sent by Thomassen, we shall process your personal data based on our legitimate interest Article 6.1(f) and compliance with legal obligations, to which we are subject Article 6.1(c) of the GDPR.

How we process personal data

We shall process your personal data in lawful, proper and transparent way.

We use appropriate technical and organisational measures to protect personal data and to help prevent theft, misuse and unauthorised access, disclosure, alteration and destruction of information.

Retention period

Thomassen will retain your personal data for as long as necessary for the duration of our business relations with you, to meet your requests, to provide our services or to deliver the products, to comply with applicable legislation or to carry out our business activities otherwise. In addition, we retain your data only to the extent necessary to comply with statutory retention obligations or for the duration of legal disputes in order to protect our legitimate interests. We will delete your data immediately if they are no longer needed for the purposes mentioned.

Your rights

As a data subject, you have certain rights:

  • Right to information about the processing operations: what happens to your personal data and why?
  • Right of access: you have the right to request Thomassen to show you whether Thomassen processes your personal data, and if so, which ones.
  • Right to rectification: you may request Thomassen to correct or supplement data.
  • Right to be forgotten: you have the right to request Thomassen to delete your personal data. It is then up to Thomassen to determine whether that request is justified. This may be the case if the personal data is no longer necessary for the purposes for which it was processed or if the personal data has been unlawfully processed.
  • Right to restriction of processing: you have the right to request Thomassen to restrict the processing, for example if the data is incorrect or the processing is unlawful.
  • Right to data portability: you have a right to ask that we transmit your personal data which you provided to us to another organisation or to you. We shall do it if it is technically feasible for us.
  • Right to object: You have the right to object to the processing of your personal data on grounds relating to your particular situation. Thomassen will cease processing unless there are compelling legitimate grounds for the processing that outweigh your interests, rights, and freedoms.

If we use your personal data on the basis of your consent, you have the right to withdraw this consent at any time.

Thomassen will provide information about the actions taken in response to the request as soon as possible, but in any event within one month of receipt of the request. Thomassen may extend this period by two months in view of the complexity of the request or the number of requests that Thomassen receives. In that case, Thomassen will inform you accordingly.
